1. Acceptance of Terms

By downloading, accessing, or using the Evolyn mobile application ("Evolyn" or the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

2. Assumption of Risk and Liability Release

Evolyn encourages users to participate in real-world "microadventures" and challenges. By participating, you acknowledge that:

  • You engage in all activities at your own risk and are responsible for assessing your own capabilities before undertaking any challenge.
  • You are solely responsible for obtaining any necessary Credentials (e.g., driver's licenses, certifications) and Assets (e.g., safety gear, vehicles) required.
  • You are solely responsible for checking current weather conditions, local authority notices, and any potential physical or legal closures (such as trail closures or hazard warnings) before starting a mission.
  • To the fullest extent permitted by applicable Canadian law, Evolyn and its creators disclaim any liability for injuries, damages, or losses incurred during these activities.

3. User-Generated Content

Content within Evolyn may be created by other users ("User-Generated Content"). You acknowledge and agree that:

  • Evolyn does not independently verify the accuracy, safety, or reliability of any User-Generated Content.
  • User-Generated Content may or may not include Difficulty Simplified (DS), Credentials Simplified (CS), and Assets Simplified (AS) ratings. When present, these ratings are subjective estimates provided by the creator, and they may be incorrect, incomplete, or unsuitable for your specific skill level.
  • It is the strict responsibility of the person participating to independently verify the hazards and requirements before they start.

4. Content Ownership and Licensing

You retain all ownership rights to the User-Generated Content you create and submit to Evolyn. However, by submitting content, you grant Evolyn a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, copy, reproduce, adapt, modify, publish, display, and distribute your content across the Evolyn platform and in related promotional materials.

5. Private and Commercial Use

Standard Evolyn accounts are strictly for private, non-commercial use in alignment with our "Common Adventure" philosophy. You may not use a standard account to run paid guided tours or for other commercial purposes. Commercial use of the platform will only be permitted through specialized paid commercial accounts, subject to separate commercial terms and conditions.

6. User Conduct and Community Guidelines

Evolyn fosters a democratic and supportive "Common Adventure." Users agree to treat others with respect, share responsibilities and expenses equitably where applicable, and avoid any unlawful, harmful, or abusive behavior on the platform.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of [Insert Province, e.g., Ontario or British Columbia] and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that province.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes, and continued use of the app constitutes acceptance of the updated Terms.
